Florida Car Accident Laws
A driver involved in an automobile accident causing injury in Florida has certain legal steps that he or she must take, such as contacting the police promptly. It’s important to follow the law after a car crash, wait patiently for the police and provide all the required information to others involved in the accident and the investigating officer. What Should You Do After a Car Crash?
-
- Exchange information. Florida law requires that if you’re involved in a motor vehicle accident, you must stop immediately at the accident scene. You are required to provide aid to any injured person and give your name, address and vehicle registration information to other motorists involved. In other words, you have a legal responsibility to give information and render aid to the injured. It’s also wise to ask for the same information from the other drivers.
- Call authorities. After a collision, you should promptly contact the police, local sheriff’s department or Florida Highway Patrol to report any accident. It is important that you not make any admissions of fault to anyone about the accident or talk to the insurance company for the other party. This could hinder your ability to receive fair monetary compensation.
When the police arrive, Florida law requires you to provide your driver’s license, registration, and proof of insurance to the investigating officer. It’s a misdemeanor to present proof of insurance known to be invalid. - Get an accident report. The law officer will fill out an accident report. You’ll want to obtain a copy of the report in the days after the accident and call the police to correct any errors or omissions in the report.
- Get medical attention. If you were injured, it is important that you seek medical help immediately to prevent the injuries from becoming worse. Even if you don’t believe you have any injuries or if you are just stiff or sore, you should seek immediate medical attention at the emergency room or from your family doctor, to rule out any injuries or get treatment as appropriate.
- Consult a lawyer. If you were injured in an automobile accident or collision caused by another motorist, you may have a legal right to seek compensation for your injuries. An experienced Florida car accident attorney can evaluate your accident and discuss your legal options.
