Florida Premises Liability Lawyer

Premises-Liability-ImagePhilip DeBerard, Injury Attorney, knows that many “accidents” are not really accidents. Every day, Florida residents are injured or killed while on the property of another person or business. Injuries and deaths often result from a property owner or business ignoring hazards or safety issues on their premises. That property owner or business can be held accountable for physical injuries, pain and suffering and financial losses caused by their negligence.

Philip DeBerard, Injury Attorney, provides legal help to victims of dog bites, slip-and-falls, swimming pool accidents and other premises liability accidents across South Florida and the Treasure Coast. For a free consultation, call us today at 1-800-299-8878 or use our online contact form.

Common Florida Premises Liability Lawsuits

Generally speaking, Florida property owners have a duty to ensure their property is safe for visitors. This applies to owners of residential property (houses, condos and apartments) as well as commercial property owners (such as those who own offices, stores, malls, shopping centers and restaurants). The duty extends to the entire property and everything within it, including any buildings, sidewalks, stairs and parking lots. The duty also applies to those who are renting or leasing the property.

When a person files a personal injury or wrongful death lawsuit against a negligent property owner, it is often called a “premises liability lawsuit.” Many different types of accidents fall into this category. They include:

  • Dog bites and animal attacks The American Veterinary Medical Association (AVMA) reports that 4.5 million people annually get bitten by dogs, and Florida is one of the states with the most dog bites reported (as of 2021). The Florida Department of Health adds that each year, an average of two Floridians die and more than 600 are hospitalized due to dog bite injuries.
  • Slip and fall accidents Annually, more than 1 million slip-and-fall incidents result in a trip to the emergency room, according to the National Floor Safety Institute. These injuries can range from mild to deadly. Slip and fall accidents are one of the leading causes of traumatic brain injury (TBI), which can require medical attention for the victim’s lifetime.
Common hazards or safety issues that can lead to a slip-and-fall accident include: broken or uneven sidewalks, floor tiles, decking and steps; obstructed walkways, sidewalks, store aisles or stairways; inadequate lights in parking lots, entryways, hallways, stairways and stairwells; broken handrails and stair treads on stairways; malfunctioning doors, windows, elevators and escalators.
  • Swimming pool accidents The Centers for Disease Control and Prevention (CDC) estimates that drowning kills 4,000 people in the US each year — an average of 11 drowning fatalities per day. In addition, an average of 22 people per day get injured in drowning incidents.
The CDC further discovered that inadequate pool fences are a factor in swimming pool accidents. Its research found that a four-sided pool fence reduces the risk of child drownings by 83 percent.
